Digital Millennium Copyright Act Notice & Takedown Procedures

Introduction

Rock-Out respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Rock-Out will respond promptly to claims of copyright infringement committed using the Platform. This policy outlines how to file a DMCA takedown notice, how to file a counter-notice, and the process we follow upon receipt.

Filing a Takedown Notice

If you believe that content on Rock-Out infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following:

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)
  3. Identification of the infringing material and information reasonably sufficient to allow Rock-Out to locate the material on the Platform (e.g., a URL or description of where the content appears)
  4. Your contact information, including your name, mailing address, telephone number, and email address
  5. A statement of good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
Counter-Notice

If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the US, any judicial district in which Rock-Out may be found), and that you will accept service of process from the person who provided the original DMCA notice
DMCA Process

Upon receiving a valid DMCA takedown notice, Rock-Out will:

  1. Remove or disable access to the allegedly infringing content promptly
  2. Notify the alleged infringer that the content has been removed and provide a copy of the takedown notice
  3. Process counter-notices: If a valid counter-notice is received, Rock-Out will forward it to the original complainant and inform them that the removed content may be restored in 10 to 14 business days unless the complainant files a court action seeking to restrain the alleged infringer
  4. Restore content if no court action is filed within the 10-14 business day window after a valid counter-notice
Repeat Infringer Policy

In accordance with the DMCA, Rock-Out maintains a policy of terminating the accounts of users who are repeat infringers of copyright in appropriate circumstances. If a user receives multiple valid DMCA takedown notices, their account will be permanently terminated.
